Trademark & Copyright Law
Your Brand Is an Asset. Protect It Like One.
Trademark counsel for Florida businesses — from first filing to federal court
Ask any business owner what their company would be worth without its name, and the answer is usually the same: a lot less. Your name, logo, and reputation carry the goodwill you’ve spent years building — and under U.S. law, they’re property you can register, license, and enforce. That’s what trademark law protects.
Capital Partners Law helps businesses across Miami-Dade, Broward, and Palm Beach counties secure and defend their brands: choosing protectable marks, clearing them before launch, registering them with the United States Patent and Trademark Office (USPTO), and enforcing them when competitors get too close. Because we’re business lawyers first, we treat your trademark portfolio the way you do — as an asset that should grow in value alongside the company it represents.
Whether you’re naming your first product or managing an established brand, the right time to think about trademark protection is before someone else does.
How We Protect Your Brand
1. Search & Clear
Before you fall in love with a name, we confirm it's actually available — with searches that catch conflicts a free knockout check misses.
2. File
We prepare and file your USPTO application — use-based or intent-to-use — and answer examiner refusals and office actions along the way.
3. Register
Registration brings nationwide priority, legal presumptions of ownership, and the right to use the ® symbol.
4. Monitor
We watch new filings and the marketplace so conflicting marks get caught early — when they're cheapest to stop.
5. Enforce
From cease-and-desist letters to TTAB proceedings and federal litigation, we enforce your rights when it counts.
Register With Confidence
Federal registration is the strongest protection your brand can get
Common-law rights exist the moment you use a mark in commerce, but they stop at the edge of your actual market. Federal registration under the Lanham Act is what turns a local brand into a protectable national asset. We handle both use-based and intent-to-use applications — so you can even reserve a mark before your product ships. Registration gives you:
- Nationwide priority over later users, even in markets you haven’t entered yet
- Legal presumptions of ownership and validity if you ever end up in court
- The ® symbol, which by itself deters most would-be copycats
- Access to federal court and remedies that can include treble damages in counterfeiting cases
- A public record in the USPTO database that blocks confusingly similar applications
- A foundation for international protection through the Madrid Protocol
Florida businesses can also register marks with the state under Chapter 495, Florida Statutes — narrower protection, but faster, and useful for purely local brands. We’ll tell you honestly which your business needs. Sometimes it’s both; sometimes registration can wait.
Before You File: Clearance Is Everything
Most trademark problems start with a name someone else used first
The most expensive trademark mistake isn’t a lawsuit — it’s a rebrand. New signage, new packaging, new domain, lost customer recognition: all because nobody checked whether the name was available before launch.
A real clearance search goes beyond a quick USPTO lookup. We examine federal registrations and pending applications, state filings, business records, domains, and common-law uses that never appear in any registry — then give you a straight answer about your level of risk. If an examiner later refuses your application over a likelihood of confusion, or calls your mark merely descriptive, we respond with a legal argument, not a shrug.
Some names aren’t worth fighting for. Part of our job is telling you that early, when changing course costs almost nothing.
Registration Isn't the Finish Line
Monitor the market — and enforce, or your rights erode
Trademark rights are use-it-or-lose-it in a very real sense: owners are expected to police their own marks, and no agency does it for you. Let competitors chip away long enough and your mark’s distinctiveness — and its legal strength — erodes.
We monitor new USPTO filings and the marketplace for conflicts, oppose confusingly similar applications during their 30-day publication window, and pursue cancellation of registrations that should never have issued. When infringement happens in the market, we escalate deliberately: a well-aimed cease-and-desist letter resolves most disputes, and Trademark Trial and Appeal Board (TTAB) proceedings or federal-court litigation are there when it doesn’t.
And when your brand becomes something others want to use, we draft the licenses that let you say yes — with the quality controls that keep the license from weakening your mark.

Why Businesses Choose Capital Partners Law
Florida-licensed attorneys with real USPTO experience
Every trademark matter here is handled personally by a Florida-licensed attorney — not routed through a call center or a do-it-yourself filing platform. We’ve seen what those services leave behind: defective filings, missed deadlines, and applications that quietly went abandoned. When your brand is on the line, experience with the USPTO’s process is what keeps your application moving.
Just as important: we’re business lawyers, not a filing mill. Your trademark strategy gets built around your actual plans — the markets you’re entering, the products on your roadmap, the exit you may eventually want. A trademark portfolio shows up in due diligence on every acquisition and financing; we make sure yours helps the deal instead of holding it up.
And because our practice spans contracts, transactions, and commercial litigation, the same firm that registers your mark can license it, defend it, and litigate it — in Florida’s state and federal courts.
Frequently Asked Questions
Do I have to register my trademark, or do I get rights automatically?
Using a mark in commerce creates limited “common-law” rights in your actual market area, but federal registration with the USPTO provides far stronger, nationwide protection and a much better footing to enforce your rights. Registration also puts the public on notice and lets you use the ® symbol.
What is a trademark search, and why does it matter?
A trademark search checks existing federal, state, and common-law marks to assess whether a proposed name or logo is available and whether it risks infringing an existing mark. A clearance search before filing reduces the chance of a USPTO refusal — or an expensive rebrand later.
How long does trademark registration take?
Federal trademark registration typically takes several months to over a year, depending on USPTO processing times and whether the application receives an office action or an opposition. We keep you informed at every stage.
Can any lawyer file my trademark with the USPTO?
The USPTO requires that an attorney representing an applicant be an active member in good standing of a U.S. state bar. Non-U.S.-licensed attorneys and non-attorneys cannot represent applicants, and using one can jeopardize the application.
How do I protect my trademark from infringement?
Trademarks are protected by registering them, monitoring the market and new USPTO filings for conflicts, and enforcing your rights — through cease-and-desist letters, TTAB opposition or cancellation proceedings, or litigation when necessary. Proactive monitoring keeps enforcement options open and affordable.
What's the difference between a trademark and a copyright?
A trademark protects brand identifiers — names, logos, and slogans that distinguish your goods or services. A copyright protects original creative works such as writing, software, photos, and video. They protect different things, and many businesses need both.
Do I need to register a copyright if my work is automatically protected?
Copyright exists automatically once an original work is fixed in tangible form, but registration with the U.S. Copyright Office is required before filing an infringement lawsuit, and timely registration enables statutory damages and attorney’s fees. Registration significantly strengthens enforcement.
