Florida Appellate Law
Your last chance in court
Make it count
When you’ve got just one last chance in court, you need to make it count. Capital Partners Law provides comprehensive, high-quality appellate and litigation-support services to trial lawyers and their clients throughout Florida. Whether you lost at trial and need to overturn the result, or won and need to protect your judgment on appeal, our appellate attorneys bring the focused research, persuasive writing, and procedural precision that appellate courts demand.
When the stakes are highest
An appeal is your last chance in court
When your case goes up on appeal, the stakes are high. If the trial court ruled against you, an appeal is your last realistic chance for the outcome you want. If you won at trial, an appeal puts that hard-won victory at risk — the other side now gets to argue the trial court got it wrong. Appellate courts don’t re-try your case or re-weigh the evidence; they review the trial record for legal error under demanding standards of review. That’s why having a capable, experienced appellate lawyer is crucial to your case.
Deep appellate knowledge
We know Florida's appellate process
It is vital to retain seasoned counsel with deep knowledge of the appellate process in Florida. Beyond trial-support services, our appellate lawyers represent clients in all six of Florida’s District Courts of Appeal and the U.S. Court of Appeals for the Eleventh Circuit. We handle the full appellate lifecycle – preserving error at trial, filing the notice of appeal, designating the record, and crafting the briefs and oral argument that decide your case.
Appellants & appellees
We handle both sides of the appeal
Whether you’re the appellant or the appellee, we can help — supporting clients in commercial, civil, and business litigation, whether you’re pursuing a claim or defending one. Winning at any level begins with comprehensive research, clear and concise writing, and well-reasoned legal analysis. We identify the issues most likely to move the court, frame them persuasively, and guide you through every step of the appellate process — keeping you informed and realistic about your odds at each stage.

Why appellate experience matters
Trial skills aren't appellate skills
Appeals follow different rules than trials. Trials are governed by the Florida Rules of Civil or Criminal Procedure; appeals by the Florida Rules of Appellate Procedure (and the Federal Rules of Appellate Procedure for federal appeals). Most appeals are decided by three-judge panels — not juries — so the skills that make a trial lawyer effective are distinct from those of a successful appellate advocate. The most valuable skills in an appellate lawyer include:
- Experience
- Writing skills
- Communication skills
Your appellate attorney must be an effective writer. In federal court, many appeals are decided solely on the briefs — without oral argument — so writing finesse and excellent brief execution are essential to the outcome. Our appellate services include:
- Civil appeals
- Commercial litigation appeals
- Business litigation appeals
- Appellate brief writing
- Oral argument
- Post-trial and post-judgment motions
- Petitions for review and certiorari
- Trial-support services
At Capital Partners Law, we bring significant experience, proven writing, and the communication skills that win cases — and we’re well-versed in Florida’s court system and appellate procedure. Winning on appeal demands seasoned appellate representation: a lawyer who can distill a complex record into a clear, compelling argument and anticipate the questions a three-judge panel will ask. That’s exactly what we provide, and we do it efficiently and transparently.

The Florida Appellate Process: What to Expect
Appeals follow a structured path with strict deadlines. Knowing how it works helps you understand what to expect, and why acting quickly matters. A typical Florida appeal moves through these stages:
- Notice of Appeal – in most cases you have just 30 days from the final order to file. This deadline is jurisdictional: miss it, and you generally lose the right to appeal.
- The Record on Appeal – the clerk and court reporter assemble the record (pleadings, transcripts, and exhibits) the appellate court will review.
- Initial Brief – the appellant files the opening brief, identifying the legal errors and arguing why the decision should be reversed.
- Answer Brief – the appellee responds, defending the trial court’s ruling.
- Reply Brief – the appellant may reply, sharpening the key issues for the court.
- Oral Argument – in some cases the court hears argument; many appeals are decided on the briefs alone.
- The Decision – a panel of (usually three) judges issues a written opinion that affirms, reverses, or remands the case.
- Post-Decision Motions – a motion for rehearing may follow.
Because these deadlines are unforgiving, especially the 30-day window to file a notice of appeal, it is wise to involve appellate counsel as early as possible.
Frequently Asked Questions
What is an appeal?
An appeal is a request for a higher court to review a lower court’s decision for legal error. An appeal is not a new trial — the appellate court reviews the existing record and legal arguments rather than hearing new evidence or witnesses.
Why hire an appellate attorney instead of the trial lawyer?
Appeals require different skills than trials — identifying preserved legal errors in a cold record, persuasive brief writing, and rigorous legal analysis. A dedicated appellate attorney often brings a more objective view of the case and focuses on what persuades an appellate panel.
How long do I have to file an appeal in Florida?
In Florida, a notice of appeal generally must be filed within 30 days of the final order being appealed. This deadline is jurisdictional, meaning that missing it usually forfeits the right to appeal, so it is critical to act quickly.
Will an appeal include a new trial or new evidence?
No. An appellate court reviews the existing trial record for legal error under specific standards of review; it does not re-try the case, hear new evidence, or take new testimony. The focus is on whether the law was correctly applied below.
Which courts handle appeals in Florida?
Florida state appeals are generally heard by the state’s District Courts of Appeal, and federal appeals from Florida by the U.S. Court of Appeals for the Eleventh Circuit. The court depends on which trial court issued the decision being appealed.
What are my chances of winning an appeal?
The likelihood of success on appeal depends on the legal issues preserved at trial, the applicable standard of review, and the strength of the legal arguments — not simply disagreement with the outcome. An appellate attorney can review the record and provide a candid assessment.
Does the firm represent both appellants and appellees?
Capital Partners Law represents both appellants and appellees in civil, commercial, and business appeals.
